TERMS AND CONDITIONS:

 

  1. Definition and Payment

    1. “ADC” shall mean Doula Spirit Pty Ltd T/A Australian Doula College.

    2. “Guest” shall mean the Guest as specified above.

    3. Time for payment for the Services shall be of the essence and will be stated on the invoice. If no time is stated then payment shall be due seven (7) days following the date of the invoice.

    4. At ADC’s sole discretion, payment for approved Guests shall be made by instalments in accordance with ADC’s payment plan.

  2. Default

    1. Interest on overdue invoices shall accrue from the date when payment becomes due daily until the date of payment at a rate of 2.5% per calendar month and such interest shall compound monthly at such a rate after as well as before any judgement.

    2. In the event that the Guests payment is dishonoured for any reason the Guest shall be liable for any dishonour fees incurred by ADC.

    3. If the Guest defaults in payment of any invoice when due, Guest shall indemnify ADC from and against all of ADC’s costs and disbursements including on a solicitor and own client basis and in addition all ADCs nominees costs of collection.

    4. If any account remains overdue after thirty (30) days then an amount of the greater of $20.00 or 10.00% of the amount overdue (up to a maximum of $200) shall be levied for administration fees which sum shall become immediately due and payable.

    5. Without prejudice to any other remedies’ ADC may have, if at any time the Guest is in breach of any obligation (including those relating to payment), ADC may suspend or terminate the supply of Services to the Guest and any of its other obligations under the terms and conditions. ADC will not be liable to the Guest for any loss or damage the Guest suffers because ADC exercised its rights under this clause.

  3. Privacy Act 1988 

    1. The Guest agrees for ADC to obtain from a credit reporting agency a credit report containing personal credit information about the Guest in relation to credit provided by ADC.

    2. The Guest agrees that ADC may exchange information about the Guest with those credit providers named in a consumer credit report issued by a credit reporting agency for the following purposes:

      1. to assess an application by the Guest; and/or

      2. to notify other credit providers of a default by the Guest; and/or

      3. to exchange information with other credit providers as to the status of this credit account, where the Guest is in default with other credit providers; and/or

      4. to assess the credit worthiness of the Guest.

    3. The Guest consents to ADC being given a consumer credit report to collect overdue payment on commercial credit (Section 18K(1)(h) Privacy Act 1988). 

    4. The Guest agrees that personal credit information provided may be used and retained by ADC for the following purposes and for other purposes as shall be agreed between the Guest and ADC or required by law from time to time:

      1. provision of Services; and/or

      2. marketing of Services by ADC, its agents or distributors in relation to the Services; and/or

      3. analysing, verifying and/or checking the Guest’s credit, payment and/or status in relation to provision of Services; and/or

      4. processing of any payment instructions, direct debit facilities and/or credit facilities requested by the Guest; and/or

      5. enabling the daily operation of Guest’s account and/or the collection of amounts outstanding in the Guest’s account in relation to the Services.

    5. ADC may give information about the Guest to a credit reporting agency for the following purposes:

      1. to obtain a consumer credit report about the Guest; and/or

      2. allow the credit reporting agency to create or maintain a credit information file containing information about the Guest.

  4. Cancellation Policy:

    1. If cancelled before 31 July, a full refund will be given, less the non-refundable deposit of $300.00.

    2. If cancelled between 1 August and 31 August, 50% refund will be given, less the non-refundable deposit of $300.00.

    3. If cancelled between 1 September and 30 September, 20% refund will be given, less the non-refundable deposit of $300.00.

    4. If cancelled after 30 September no refund will be given.

 

 

Should, for any reason outside the control of the ADC, the venue or speakers change or the event be cancelled, the ADC will endeavour to reschedule. In this instance the delegate will indemnify and hold the ADC harmless from and against any and all costs, damages and expenses.
